Legal Basis for Processing Data
TDP Development Ltd’s lawful basis for processing your data is, generally, with regard to consent or a contractual agreement, between TDP Development Ltd, as the data controller, and our Client.
Whereby a legitimate interest forms the lawful basis for processing personal information, TDP Development Ltd applies a three-part test:
-
Purpose test - Is there a legitimate interest to process personal information?
-
Necessity test - Is the processing necessary to achieve that purpose?
-
Balancing test – do the individual’s interests override the legitimate interest, with relation to their rights and freedoms?
For example, the use of psychometrics is a shared legitimate interest as we, generally use the findings to inform a professional and informative 1-1 with individuals.
Anonymized statistical psychometric data is then given to the client in order for them to use the findings to further plan for the future development of their employees.
